本报赣州4月13日电驾驶电动车将行人撞倒，不但不积极施救，反而将处于昏迷状态的被害人拖至道路边缘，致被害人因抢救不及时死亡。今天，江西省瑞金市人民法院以交通肇事逃逸罪判处被告人黄帆有期徒刑四年，并赔偿被害人亲属损失75131.1元。

法院经审理查明，2009年8月29日，被告人黄帆驾驶电动车行驶至瑞明环岛红绿灯南侧路口时，其所驾车辆左前侧与相向而行的被害人王先生相撞，致王倒地。

后被告人黄帆将当时处于昏迷状态的被害人拖至道边后驾车离开现场。被害人被120接至瑞金市人民医院救治后不久死亡。交警认定，被告人黄帆发生事故后故意破坏事故现场并且驾车逃逸，应负本次事故的全部责任。

法院审理认为，被告人黄帆驾驶电动车在公共交通管理道路范围内将被害人撞倒，致被害人死亡的严重后果，事后被告人黄帆既未采取有效措施抢救，又未保护现场、报告公安交通管理部门，而是将被害人移至路边后驾车离开。

被告人黄帆的一系列行为符合交通肇事逃逸罪的构成要件，公诉机关指控的罪名成立。（钟羽敏杨益华）
